RULES FOR THE RETURN AND REPLACEMENT OF GOODS

1. CONCEPTS

 

1.1. Seller - MB "Mintico", legal entity code 305699201, address Rumpiškės str. 29-20, Klaipėda, LT-91120, Lithuania, VAT code 100013784514.

 

1.2. E-shop - this e-shop located at www.mintico.lt.

 

1.3. You / the Buyer - a natural person who, in accordance with the applicable legislation, is able to enter into agreement to purchase a goods for personal use (for non-business purposes).

 

1.4 Rules - these rules, which establish the conditions for returning and replacing the goods purchased in the E-shop.

 

1.5. Parties / Party - Buyer and Seller together or separately.

 

1.6 Goods / services - everything traded in the E-shop. The 'goods' specified in the Rules below include services where goods and services are sold in the E-shop, unless otherwise specified in the Rules.

 

2. GENERAL PROVISIONS

 

2.1. These Rules establishes the rights and obligations and responsibilities of the Buyer and the Seller regarding the return and replacement of goods purchased in the E-shop.

 

2.2 These Rules are a part of the general rules for the purchase of goods and services in the E-shop, which you can get acquainted with here: RULES FOR THE PURCHASE OF GOODS AND SERVICES IN E-SHOP.

 

3. RETURN AND REPLACEMENT OF GOODS

 

3.1. The Buyer has the right, without giving a reason, to withdraw from the purchase and sale agreement concluded in the E-shop within 14 (fourteen) days from the date of delivery (receipt) of the goods, with the exception of the agreements specified in Article 6.228(2) of the Civil Code of the Republic of Lithuania.

 

3.2 In order to return the good quality product(s), the Buyer must return the product(s) no later than within 14 (fourteen) days from the date of delivery (receipt) of the product.

 

3.3. In order to return the good quality product(s), the Buyer must fill in the return form, which can be found here, and send it by e-mail to klausk@mintico.lt. After sending the completed form, the Buyer will be contacted within 2 working days regarding the return of the goods.

 

3.4. When returning good quality goods, the Buyer is responsible for the proper packaging of the product for return. The Buyer bears the direct cost of returning the goods, unless the Seller indicates otherwise to the Buyer after receipt of the notice of withdrawal.

 

3.5. The goods can be returned by sending them to the seller of the goods at the address: MB "Mintico", Rumpiškės str. 29-20, Klaipėda, LT-91120, Lithuania., using courier/postal services. If the Buyer needs assistance related to the organisation of the return of the goods, the Buyer may contact the Seller.

 

3.6. The amount of money returned for a good quality, but not suitable to the Buyer, product is the price of the product without the delivery fee. The delivery fee is not refunded to the Buyer. The Buyer shall be refunded the money for the returned item after the goods have been returned to the Seller.

 

3.7. The Buyer shall be returned the money for the goods within 14 days to the payment account specified by the Buyer by wire transfer.

 

3.8. The Seller is not considered to have violated the terms of the money refund if he cannot refund the money due to the Buyer's fault (delay in returning the goods, inaccurate data, etc.).

 

3.9.When returning the goods to the Buyer, the following conditions must be observed:

 

3.9.1. the returned item must be in its original packaging, the packaging must be intact;

 

3.9.2. the returned item must be intact by the Buyer;

 

3.9.3. the returned item must not be used, without losing its commercial appearance (undamaged labels, protective films), this condition does not apply in case of return of defective goods;

 

3.9.4. the returned item must be in the same set as received by the Buyer;

 

3.9.5. when returning the item, it is necessary to submit a VAT invoice confirming its purchase and complete the application for return of the goods.

 

3.10. If the returned item is not fully completed, is damaged, untied and/or improperly packaged, the Seller has the right not to accept the returned item and not to return the money paid by the Buyer for the returned item.

 

3.11. In case of sale of defective goods, the Buyer may request to change the product of inadequate quality to a suitable one, reduce the price of the product, return the product and get a refund of the money paid for it. Replacement and return of defective goods shall be carried out in accordance with the procedure established by these Rules and legal acts of the Republic of Lithuania.

 

3.12. The Buyer may not return such goods for which the possibility of return is not established by the legal acts of the Republic of Lithuania.

 

3.13 In case of defective services, the Buyer has the right to demand to eliminate the defects in the provision of services, to return the price paid for the services, to reduce the price of the services.

 

4. FINAL PROVISIONS

 

4.1. These Rules are regulated by the applicable legal acts of the Republic of Lithuania and the European Union.

 

4.2. The Seller has the right to change the Rules at his discretion, unilaterally, without further notice. The changes take effect from the moment they are placed in the E-shop and are mandatory for the Buyer who wants to use the E-shop.

 

4.3. The Seller may at any time transfer its rights and obligations arising from these Rules to third parties without the Buyer's consent and without notifying him.

 

4.4. In case of disagreement between the Buyer and the Seller, they are resolved by negotiation. If the Parties fail to reach an agreement, disputes shall be finally settled in accordance with the procedure established by the laws of the Republic of Lithuania.

 

4.5. The Buyer-Consumer may submit a request and / or complaint regarding the purchase of a product or service in the Store to the State Consumer Rights Protection Service (Vilniaus St. 25, 01402 Vilnius, tel. 8 5 262 67 51, fax 8 5 279 1466, e-mail tarnyba@vvtat.lt, website www.vvtat.lt, its territorial subdivisions in counties) or fill in the application form on the Electronic Consumer Dispute Resolution Platform accessible at http://ec.europa.eu/odr/. This condition does not apply to Buyers – entrepreneurs.
